I. General provisions
1. The Federal water resources Agency (Rosvodresursy) is a Federal Executive authority performing functions of execution of state services and Federal property management in the field of water resources.

2. the Federal Agency for water resources is under the jurisdiction of the Ministry of natural resources and ecology of the Russian Federation.

3. the Federal water resources Agency is guided in its activities by the Constitution of the Russian Federation, Federal constitutional laws, Federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, acts of the Ministry of natural resources and ecology of the Russian Federation, as well as this Regulation.

4. the Federal water resources Agency carries out its activities directly or through its territorial bodies (including basin bodies) and through subordinate organizations in cooperation with other Federal Executive authorities, Executive authorities of the regions of the Russian Federation, local government bodies, public associations and other organizations.
II. Authority
5. the Federal Agency for water resources shall exercise the following powers in the established sphere of activity:
5.1. organizes:
5.1.1. territorial redistribution of surface water runoff, replenishment of water resources of underground water facilities;

5.1.2. expired on January 1, 2007. - Decree of the Government of the Russian Federation of 20.12.2006 N 781;
5.1.3. implementation of measures to prevent the negative impact of water and eliminate its consequences in relation to water facilities that are federally owned and located on the territories of two or more regions of the Russian Federation, as well as in relation to water facilities that run along the state border of the Russian Federation;

5.1.4. became invalid from January 1, 2007. - Decree of the Government of the Russian Federation of 20.12.2006 N 781;
5.1.5. implementation of measures for protection of reservoirs which are completely located in territories of the corresponding regions of the Russian Federation and use of which water resources is performed for providing drinking and household water supply of two and more regions of the Russian Federation, according to the list of such reservoirs established by the Government of the Russian Federation, and also for protection of the seas or their separate parts, prevention of their pollution, clogging and depletion of waters, implementation of measures for elimination of consequences of the specified phenomena;

5.2. performs the procedure and limits defined by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, powers of the owner concerning the federal property necessary for ensuring execution of functions of federal public authorities in established point 1 of this policy field, including property transferred to Federal state unitary enterprises, Federal state institutions and state-owned enterprises under the jurisdiction of the Agency;
5.3. in accordance with the legislation of the Russian Federation and other regulatory legal acts on the contract system in the field of procurement of goods, works and services for state and municipal needs, purchases of goods, works and services in the established field of activity;

5.4. performs the functions of the state customer of interstate, federal target, scientific, technical and innovative programs and projects in the field of the Agency's activities;
5.5. performs maintenance:
5.5.1. of state water register, including state registration of water use agreements, decisions on granting water facilities for use, transfer of rights and obligations under the water use agreement, as well as termination of the water use agreement;

5.6. executives
5.6.1. in accordance with the procedure and within the limits defined by the legislation of the Russian Federation, ownership, use and disposal of water facilities classified as federal property;

5.6.4. development, approval and implementation in accordance with the established procedure of schemes of integrated use and protection of water facilities;

5.6.5. state monitoring of water facilities and the organization of its organization;

5.6.6 - 5.6.7. became invalid from January 1, 2007. - Decree of the Government of the Russian Federation of 20.12.2006 N 781;
5.6.8. development of automated systems for collecting, processing, analyzing, storing and issuing information on the state of water facilities, water resources, regime, quality and use of water in the Russian Federation as a whole, its individual regions, and river basins in accordance with the procedure established by the legislation of the Russian Federation;
5.6.9. expired on January 1, 2007. - Decree of the Government of the Russian Federation of 20.12.2006 N 781;
5.6.10. provision of reservoirs that are completely located on the territories of the relevant regions of the Russian Federation and whose water resources are used to provide drinking and household water supply to two or more regions of the Russian Federation, in accordance with the list of such reservoirs established by the Government of the Russian Federation, or parts of such reservoirs, seas or their separate parts for use on the basis of a water use agreement or decisions on the provision of water facilities for usage;

5.6.11. hydrographic and water management zoning of the territory of the Russian Federation;

5.8. sets the modes of passing floods, special releases, filling and working out (water release) of reservoirs;

5.10. provides information from the state water register to the interested person in accordance with the established procedure or sends him a reasoned refusal to provide such information in written form;

5.11. expired on January 1, 2007. - Decree of the Government of the Russian Federation of 20.12.2006 N 781;
5.12. carries out economic activity analysis of subordinate state unitary enterprises and asserts the economic indicators of their activity, spends in the subordinated organisations of check financially-economic activities and use of property complex;
5.13. performs the functions of the chief administrator and recipient of federal budget funds provided for the maintenance of the Agency and the implementation of the functions assigned to the Agency;
5.14. interacts in accordance with the established procedure with state authorities of foreign States and international organizations in the established field of activity;
5.15. accepts citizens, ensures timely and complete consideration of oral and written appeals of citizens, making decisions on them and sending responses to applicants within the time period established by the legislation of the Russian Federation;
5.16. ensures, within its competence, the protection of information constituting a state secret;
5.16.1. implements measures to support small and medium-sized businesses aimed at their development, including the implementation of relevant departmental target programs, in the established field of activity;

5.17. provides mobilization training of the Agency, as well as control and coordination of the activities of organizations under its jurisdiction for mobilization training;
5.17 (1). organizes and conducts civil defense in the Agency, as well as controls and coordinates the activities of subordinate organizations in the performance of their powers in the field of civil defense;

5.18. organizes additional professional education for Agency employees;

5.19. performs in accordance with the established procedure work on acquisition, storage and accounting of archival documents formed in the course of the Agency's activities;
5.20. organizes congresses, conferences, seminars, exhibitions and other events related to the Agency's activities;
5.21. performs other functions for managing state property and providing state services in the established sphere of activity, if such functions are provided for by federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation.
6. the Federal Agency for water resources, in order to exercise its powers in the established sphere of activity, has the right to:
6.1. provide legal entities and individuals with explanations on issues related to the Agency's sphere of activity;
6.2. request, in accordance with the established procedure, information necessary for making decisions on issues related to the Agency's sphere of activity;
6.3. involve scientific and other organizations, scientists and specialists to work out issues related to the Agency's sphere of activity;
6.4. create advisory and expert bodies to discuss topical issues of the Agency's sphere of activity.
7. The Federal water resources Agency is not entitled to exercise normative-legal regulation in the established field of activity and function on control and supervision, except the cases established by decrees of the President of the Russian Federation or resolutions of the Government of the Russian Federation.
Restriction of powers of Agency established by the first paragraph of the present point do not extend on powers of the head of Agency for decision of personnel questions and questions of Agency activities, control of activities led by the Agency (its structural divisions).
III. Organization of activities
8. the Federal water resources Agency is headed by a head appointed and dismissed by the Government of the Russian Federation on the recommendation of the Minister of natural resources and ecology of the Russian Federation.

The head of the Federal water resources Agency is personally responsible for performing the functions assigned to the Agency.
The head of the Federal water resources Agency has deputies appointed and dismissed by the Government of the Russian Federation on the recommendation of the Minister of natural resources and ecology of the Russian Federation.

The number of Deputy heads of the Federal water resources Agency is set by the Government of the Russian Federation.
9. the Head of the Federal water resources Agency:
9.1. distributes responsibilities among his deputies;
9.2. submits to the Minister of natural resources and ecology
of the Russian Federation: Resolutions of the Government of the Russian Federation of 29.05.2008 N 404)
9.2.1. draft regulations on the Agency and regulations on its territorial bodies;
9.2.2. proposals on the maximum number and remuneration Fund for employees of the Agency's staff;
9.2.3. proposals for the appointment and dismissal of Deputy heads of the Agency, as well as heads of territorial bodies of the Agency;
9.2.4. annual plan and performance indicators of the Agency, as well as a report on Its activities;
9.2.5. submit to the awarding state awards of the Russian Federation, Honorary diploma of the President of the Russian Federation, Honorary diploma of the Government of the Russian Federation, to encouragement in the form of a Declaration of gratitude of the President of the Russian Federation, the announcement of gratitude of the Government of the Russian Federation on awarding of the departmental distinction of the Ministry of natural resources and ecology of the Russian Federation, giving the right on assignment of a rank "the Veteran of work", of the employees of the Agency, its territorial bodies and subordinate organizations, as well as other persons engaged in activities in the established field;

9.3. approves the regulations on the Agency's structural divisions;
9.4. appoints and dismisses employees of the Agency's staff in accordance with the established procedure;
9.5. resolves in accordance with the legislation of the Russian Federation on public service issues related to the passage of Federal public service in the Agency;
9.6. approve the structure and staffing of the office of Agency within established by the Government of the Russian Federation of Fund of payment and number of workers, the cost estimates for the maintenance of Agency within the limits approved for the corresponding period of the appropriation provided in the federal budget;
9.7. approves the structure, staffing and remuneration Fund of Employees of the Agency's territorial bodies within the limits established by the Government of the Russian Federation, as well as the cost estimates for their maintenance within the appropriations provided for the corresponding period in the Federal budget;
9.8. appoints and dismisses the heads of subordinate institutions and other organizations in accordance with the established procedure, concludes, changes, and terminates employment contracts with these managers;
9.9.on the basis of and in pursuance of the Constitution of the Russian Federation, Federal constitutional laws, Federal laws, acts of the President of the Russian Federation, the Government of the Russian Federation and the Ministry of natural resources and ecology of the Russian Federation issues orders on issues within the competence of the Agency.

10. Financing of expenses for the maintenance of the Central office and territorial bodies of the Federal water resources Agency is carried out at the expense of funds provided for in the Federal budget.
11. the Federal water resources Agency is a legal entity that has a seal with the image of The state emblem of the Russian Federation and its name, other necessary seals, stamps and forms of the established sample, and accounts opened in accordance with the legislation of the Russian Federation.
The Federal Agency for water resources has the right to have a heraldic sign - an emblem, flag and pennant established by the Ministry of natural resources and ecology of the Russian Federation in coordination with the Heraldic Council under the President of the Russian Federation.
